PIP Won tribunal but am I out of the wood? was created by mosala
Tribunal was positive for me. Heard 2 weeks ago. Just learnt that DWP can appeal tribunal decision! How ridiculous! I thought tribunal had the final word? So what happens if DWP appeal? Do I have to admit defeat at that point or can I appeal again?
I feel like a prisoner being interrogated rather than someone with health problems seeking support.

It is true that DWP can appeal against a tribunal decision which is no different from you appealing if you disagreed with the decision. It has to be on a point of law, the DWP will ask the Tribunal for a 'statement of reasons' within one month of the decision date and then appeal. You should be notified if DWP request a statement of reason. Even if DWP do request a statement of reason it does not mean they will appeal, if you are concerned then give HMCTS a call to see what is happening and if DWP are appealing the decision, they are very helpful once you get through.

Thanks. It is 18 days since I had the tribunal result and thought I would have received the money in my bank by now. Should I have received the back money by now do you think?

It usually takes the DWP 5-8 weeks to process a Tribunal result, have you contacted them to make sure that they have received the Decision Notice.
Any request for the SoR needs to be received by the Tribunal Service no later than one month from the date of the hearing, the TS will contact you if such a request is received.

If the DWP then appeal against the decision and are successful, can *you* then counter-appeal against that decision? Could it in theory go on and on?

It would not go on and on, when you first go for an appeal it is with 'First Tier Tribunal' you can then appeal to the 'Upper Tier Tribunal' and then to 'Court of Appeal' .... have a look at B&W latest news letter www.benefitsandwork.co.uk/news/4131-27-november-2019-update
