4. Only you can decide whether you want to appeal the mobility component. At this stage you could still receive it - because it would be counted as the transfer from DLA - in the future as I have already said, you cannot claim for it in the future.


Ah, have I been getting the wrong end of the stick? For those people who are transferring from "lifetime" DLA to PIP and are around state pension age you're saying that as long as they are transferring between the two they could potentially still get a mobility award even if they are past pension age as David appears to be, as long as it's awarded on the initial transfer application? I hadn't realised that whether it was a DLA > PIP transfer was so important (with some people seemingly being on PIP reviews already, others not even having transferred yet, and everything inbetween, it gets a little confusing trying to keep track of what's happening with PIP) - I might have asked questions differently if I'd realised the significance, because I'm not sure I ever mentioned that my caree was transferring from DLA to PIP.

I might need to go away and think about this ...

Just so everything is clear.

The relevant age is 65 or State Retirement Age, whichever is the higher.

You cannot be awarded the Mobility as a new or an increased award after you reach the relevant age with the exception of the initial transfer from DLA to PIP where the age restriction is suspended.

If you have a Mobility award before the relevant age then you can continue to receive it after as long as you continue to meet the criteria.

MRs and Appeals remake the Decision being challenged and apply from the same date so if the MR or appeal takes you past the relevant date you can still receive the Mobility Component if awarded as long as the original date was before.

I am under a bit of a strain at the moment as last week a close relative died. And it was last week that the brown envelope came. I have until 27 Dec to appeal. It seems unfair that there is no extension for appealing over Christmas given the bank holidays, closure of institutions and the slow post.

I have now carefully read the assessor’s comments. She said that I could cook but hoarding stopped me. But hoarding is not covered under PIP.I am a diagnosed hoarder so cooking is dangerous. I have had a number of fires. I am surprised that hoarding is not covered if it stops cooking. Eating cold food was deemed acceptable in the report.The assessor seems not to accept the cognitive limitations caused by hoarding. She accepts the cognitive limitations and motivational connotations of depression which I have. I also experience visual hallucinations as part of my diagnosis of schizophrenia which at times makes it difficult to accurately perceive things in my environment. The argument is that because I am under the GP not specialist mental health care then the risk is not great. But I have been denied specialist input by the CMHT because I am over 65. A charity was going to challenge this decision but I did not feel up to the fight. My GP reckons that there was little chance of succeeding. Previously I had specialist inputs at the Centre of Anxiety for OCD and hoarding. There was no mention of my dialectic status and serious skin condition which I need help with.

In the f2f it was made clear to me that there was no need for for a physical examination. Yet twice in the report it states that I refused such an examination. Apparently I carried a large pack. It was a light document bag. Why would a job as a college lecturer over 17 years be evidence of no cognitive impairment now?

Two questions. If you cannot cook because of safety matters but can eat cold food does this mean that you score low points on cooking?

I need specialist intervention in mental heath but there is age discrimination. Should the discrimination be used as evidence as a lack of need?

You can make a Late request for an MR, the loss of your relative should be accepted as Good Cause.

Cooking a meal and eating it are separate PIP activities, I'm afraid there is no requirement for the food that you eat to be cooked.

It's not clear from your post where the risk of harm derives from in your post, is it primarily something that you might cause due to your mental health issues or is down to the environment in your kitchen.

If the former then this is something that should be considered if the latter then I think the argument would be a lot tougher and I am not sure that you would actually score, certainly it is something that would only be accepted, if at all at an appeal hearing.

Providing you can show that you need the specialist input but it is not available then it should be considered as part of an assessment.
