Hello

Looking for some advice with regard to the deprivation of capital. I recently won my pip tribunal after nearly a 2 year wait, due in part to the very good guides you have on this site (thank you so much). I was awarded a backdated sum of over £7,500. I understand that this is not counted for 1 year. I have no other savings or capital. I had approx £500 in my current account at the time of the award.

I will obviously be spending a fair amount of this award so it is very likely to be well under the £6,000 lower limit after a year.

1. Do I need to inform the DWP after 1 year of this award, even though they are the ones that issued the backdated payment?

2. Do I need to provide proof ie bank statements, receipts etc?

3. As it will most likely be well under the lower limit of £6,000 after a year, do I need to contact them at all?

Hi Helen

You only need to inform DWP if your capital goes over £6k if you are under SP age, as you have stated your backdated award is not counted for the first year, all I would say is that if you have some large expenses just keep the receipts just in case DWP may ask what you spent your money on, but I cannot see it being a problem.

Hi Helen

You are correct, if your capital is below £6,000 then you do not need to inform either DWP or your LA if you receive any means tested benefits of your savings unless you have to make a new application in which case you have to declare any capital you may have.

If you are below SP age and have savings between £6,000 and £16,000 then for every £250 you loose £1.00 in tariff income, if you are of SP age then for every £500 over £10,000 you loose £1.00 in tariff income.
