ESA Award Length was created by Ultravox
Hi All,
Just a quick query. Is it possible for a Decision Maker to over rule a Health Professionals opinion on a length of award? In respect to giving an award length longer than the Health Professional advises.
Kindest Regards.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Rob,
Yes, it is and I have known it to happen, but not very often.

Hi to all,
That's the answer I wanted to hear about that question. The assessor's prognosis date was for me to be re -reviewed in June 2019. The assessment which was a PBR (paper review) was back in early June 2017.
The assessors reported in her report to the D, that the claimant (me) was very unlikely to go back to any work due to multiple health conditions bla bla bla.
So I'm left thinking maybe this has already happened to me. The DM has used his or her noddle, and the penny has dropped that finding me fit for work would be of no use to anyone and neither the DWP's time.
Has anyone on here been aware that this has happened to them, and notified by the DWP.
I look forward in hearing your replies.
Best regards.

The health assessor recommended 18 months in my case however the DM decided I should be given an ongoing award and with a review date of 10 years so I guess the answer to your question is Yes thankfully.

Hi mrf
Quite few people on ESA have been deferred, perhaps this has happened to you. My partner’s not been assessed for ESA since 2012, & I believe awards are only supposed to be for 3 years max.

I'm in a similar situation. Initially
I successfully appealed being put in the WRAG group and was placed in the SG December 2015. The Tribunal recommended not to be assessed before December 2017
Since then it was deferrred unti December 2019 and I've still not heard anything.
Looks to me like it might have happened again.
Phrank.
