Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Jacq
Not enough information to give any advice such as does the person now live alone, what type of ESA do they get, IR or CB EDA, what PIP components do they get. Do they receive a SDP? if they do then they will not be able to apply for UC.
To be eligible for the Severe Disability Premium they need to meet the following criteria;
- need to be receiving or entitled to (with the SDP) Income Related ESA
- need to be receiving a qualifying benefit such as a PIP Daily Living award (there are other benefits)
- need to be living alone or considered to be living alone
- No one must be receiving Carers Allowance against the qualifying benefit
You can see what they might be eligible for by putting their information into one of the online benefit calculators.

Hi thanks for your reply.no they now live on there own and never had severe disability premium because of living with parents.they get esa income related support group and p I p both enhanced.but were advised last week to claim universal credit for to cover housing cost and council tax.I am just trying to help because causing them so much distress.
Previously they did apply for severe disability premium in Nov 2019 but we're told because there dad only got disability living allowance low rate, they weren't entitled to it.
Thankyou

Hi Jacq
They should contact ESA enquiry line 0800 169 0310 and request SDP, it should be paid from the date when their father died, providing they met the qualifying conditions.
They should contact their LA to claim HB and explain that SDP has been applied for, if not they will be told to apply for UC.
It is important that no one claims Carers Allowance for them if anyone does, then they will not be able to claim SDP and HB.

Thank you for reply.I wish I had helped them ring esa and claim sdp because local h/b told them they must apply for universal credit for rent and council tax and they have done that..because they were frightened that rent wouldn't get paid.
They haven't informed esa about anything, but would it be to late now for them to ring esa up please ?
Thanks

Sorry I meant to add that universal credit said they can't claim rent yet because the tenancy needs changing over.and no payments have be made from universal credit of any amounts.last payment was made on the 4th of may from esa...and the 4th of may was when they were told to claim universal credit to claim housing costs.
Your help and advice is really appreciated because all this what LA have advised is causing them more distress.
Thankyou
