Hi diceman24

Things to think about for Moving Around

You are not required to walk pain free but any pain that restricts the distance that you can walk should be taken into account.

Specifically for the Moving Around activity, if you are able to walk but you are in severe pain when doing so, then you can argue that your walking is not to a necessary standard and should be disregarded.

The legal test requires you to stand and then move (walk), so if you have problems getting up then you should document these as well.

If you walk slowly then it must take you at least twice the time to cover the distance as a healthy person would, this could be down to the speed of your walking but could also be the result of having to stop.

You must be able to repeat the distance, so if you could walk it once but not then be able to walk it again within a reasonable timescale then you should be classed as unable to repeat the activity.

I'm afraid I can't tell you how to show your walking is more restricted but things you need to think about is what you can't do, for example what can you walk in your house, how far is the toilet from where you normally sit, things that will count against you are any trips that you make outside, so for example, how do you do your shopping?

You must be able to walk the distance you can, reliably and on the majority of days, both these terms are defined in the PIP Claim guide

www.benefitsandwork.co.uk/help-for-claimants/pip

So you need to explain what you can, how you are limited and why.

Dice man I measured our garden which as it turns out is 20 meters long, and timed my husband walking it, and then me struggling to walk it!I timed how long I paused for too. I then had this specific information to share on the assessment call. at my last face to face she apparently watched me walk from the room and then sit down in the foyer as I left the assessment as she noted that I sat after 15 meters and even how long I sat for!

As far as I am aware every time you need to stop and rest then the amount of distance you can walk is reset. Do you use any aids? and have you any letters (from medical professionals)stating your walking is affected. I use a walker outside and a stick indoors and have letters from my medical team backing up my use of them.
As my condition (Multiple sclerosis) is progressive I also mentioned that, so that any assessors can't assume I'm going to improve.

This is not the case unless the time stopped for is excessive, however, the time stopped for must be taken into account when calculating the time to walk a distance.

My partner was put down from high rate mobility to low rate. He attended a face to face assesment 3 years ago and hcp said he would struggle to walk more than 15 metres due to arthritis in spine and breathing problems from heart disease .He had a telephone assesment in August and they put him down to low rate mobility said he didnt sound breathless over the phone .I have challenged this at mandatory reconsideration as how can a hcp tell how far someone can walk over the phone when 3 years ago he couldnt walk 15 metres ...
