Pip unsuccessful - next steps? was created by KPPurple
Hi
I have been informed that my PIP assessment has been unsuccessful. I only got the enchanced mobility component and nothing for daily living even though I have sight loss and use aids.
I am awaiting the award letter, as I recieved a payment into my bank account before I’ve recieved the award letter and phoned to query what it was in relation to which was the enchanced mobility.

I am shocked that I’ve recieved nothing for daily living even though I use aids to help manage. Any suggestions as to why this may have happened?

Has there been a change to awards due to telephone assessments?

What are the next steps?

Ps I live in one of the nation countries, so don’t know if the process is different here.

Hi KPPurple

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim. Make sure you inform DWP that you have no issues with the mobility component, it is the daily living component that needs to be reviewed, but as stated earlier, you need to fit the criteria to be eligible, so check out our guide.

Have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

Hi Gary
Thanks for that information. I’ll have to wait until I receive the decision letter to see how long the award is for.
I was reading through the appeals booklet on the website and have a question.
I recieved high mobility and no component for daily living. At this stage I don’t know how long the award is for.
If I ask for a mandatory reconsideration and only ask that daily living be looked at. Can they decide to look at mobility also?
Would it be worth appealing?
Can I ask for the mandatory reconsideration to be extended? As the letter was sent out on 25th November which I’ve yet to receive and it is coming into the holidays.

Hi KPPurple

1) Yes they could decide to look at the whole award, but why would they?

2) Before you can appeal you have to request a MR, MR are usually made within one month of the decision date, you can do out of time MR but you have to have a good reason such as ill health. If you disagree with the MR, then you can appeal.

3) No, you cannot extend a MR, but you can do an out of time MR, see above.

Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Hi Gary
The issue with the MR is currently I’ve not received the decision letter and yet it’s dated 25 November as they told me that when I phoned. So, 4 weeks after that is 25 December. Which isn’t enough time considering that I’ve yet to receive the letter.
Also, if I need to request the assessment report by dfc that’ll not be with me for a few weeks at least due to them using snail mail and coming up to the Christmas holidays.
I am also working with an organisation to support me with the appeal.

Hi KPPurple

It's not the decision letter you want but the assessors report, that is the key document to chase so you can put in a MR, but as stated previously, if it is late coming then you will have to do an out of time MR (13 months) and quote the late arrival of both decision letter and assessors report for putting in a late MR, I have done numerous out of time MR, usually once you put in a MR you are sent the same decision letter as the original claim, in which case you can then put in an appeal.
