Hi
I have to re apply for my PIP which ended 08/12/20, submitted new application 02/11/20, still haven't heard anything.
When I call the DWP to ask about the 2016 ruling, I always get a different answer.I fall into the bracket 4 points needs prompting, but according to the new rule I should score higher as I need prompting along the journey.
Has anyone had any dealings with this, or recieved a back dated award?

I am aware of the ruling but not come across it myself and cannot recall members on the forum receiving a backdate although there have been a few discussions on the subject. Members on this forum may be able to give you more information.

I too was originally awarded 4 points for mobility in 2017, after I received a DWP letter in 2019 saying they were not increasing the award I put in a MR which was rejected .
I then lodged an appeal and about 10 weeks in I received a phone call from a decision maker offering me 10 points- standard mobility. I was happy with this, what was more telling was that they referred to a GP letter and in particular one sentence for the reason they were able to increase the award. This was not new evidence, I had referred to it in my MR but it had been conveniently ignored/overlooked.
So my view is it is worth challenging this even if your submitted evidence has previously been ignored although you may have to hold your nerve and lodge an appeal. I received just over £3000 in backdated payments.

Hi, From 28 November 2016 there was a change to the way DWP considers how overwhelming psychological distress affects your ability to plan and follow a journey.

DWP will now consider how this affects your ability to plan and follow a journey when it decides whether to award the mobility part of PIP. DWP will also consider this when it decides whether to award: this would mean more than just prompting and you would have to show that you suffer with overwhelming psychological distress. You would need to evidence this as it appears they have set the bar quite high for this descriptor. DWP have the ability to look at your previous claims and make a decision to see if you meet this threshold. I hope this helps ......
