Hi AW Perhaps I can try and explain some historical context. Back in 2014 or 2015 DWP were maintaining that only descriptors 1b and 1e comprised overwhelming psychological distress. Needless to say this was appealed and the Supreme Court decided this wasn't correct. But aha, DWP then made some quick amendments to the actual rules., reversing the judges' ruling.. However DWP had not followed the correct process for amending the regulations and the new rules were deemed unlawful. Bearing in mind some time had elapsed, DWP had erroneously refused benefit on the basis of the unlawful new rules. Hence they had to review all relevant cases and award the correct points and hence money where applicable. The comments made on this topic suggests it still hasn't been done with all cases. But if a review is done and a new award made, then yes, there should be a back dated payment! This may help explain what is happening here. LL26
