We have received the assessors report and adding up the points she got:
11 for Care = Standard
12 Mobility = Enhanced.

The assessor (a nurse) seem nice and helped by putting words, nice ones in her mouth to help her answer. All in all the report is actual not bad.

I know we need to wait for the actual award letter as the decision maker to add or take away points, but it it stays as is we are thinking of putting in a MR. as there are a few contradictions between what the assessor wrote about what was said in the call and her reasoning for not giving points.

This is one example:

Descriptors
Managing therapy 0 points
Assessor states she manages medications unaided

But in the first part of the report (not the descriptors sheet), assessors states “therefore someone will wake her up to give medications”.

My daughter told her this happens at least twice a day.
It states also states she uses BP machine and self catheters.
But someone does the BP for her and she told them she has real problems with self catheters, due to very tight urethra, bleeding etc.

Assessors says she does physio alone, but this is not current. She needs lots of promoting and assistance.

Its the managing therapy descriptor which we think is really wrong. Her actual form had19 pages of doctors and specialist letters and two typed A4 pages just for this descriptor explaining all the assistance she requires.

Daughter mention fatigue all the way through the assessment and the assessor mentions it a lot in her report, but hasnt award points for fatigue where we believe she should of.

Under Observations assessor has written
She spoke slowly, sounded in pain, expressed fatigue throughout but became much worse towards the end and she began to need questions repeating as she struggled to focus.
But then states a few sentences later that she did not need prompting....surely struggling to focus and having to repeat questions demonstrates this?

If we put in a MR, will she still get her award monies while this is going through?

Is there anything she should be aware of doing a MR. decides it has to be done within a month?

Hello Lorraine,

Since you have the assessor's report but you have not yet had a decision from the DWP you can write to them with 'additional information'. Basically where you believe the assessor got it wrong. At this stage it is not a Mandatory Reconsideration (MR) and your letter should state this. After the decision has been made is your opportunity to request a MR if you are still not happy.

I would recommend that you write this as soon as possible since it needs to get into your daughter's file before the case manager makes his decision. Having posted it, I would also recommend ringing the DWP and telling them you are submitting additional information and you would appreciate it if they would put a note on the file for the case manager's attention to the effect that you request they pospone making a decision until they have received it.

Thank you.

She had her assessment on 6 July, so worried that if she gets help to write this letter then it may come after the decision maker has seen her file, and she would of used all her precious energy?

I suppose it’s a gamble but maybe worth doing?

Hi Lorraine,

I would not see it as much of a gamble since if it does not get there in time it will form the basis of her Mandatory Reconsideration request - so the energy will not be wasted.

Called DWP to see if decision had been made, as we wanted to add evidence.

According to the report she got 11 points care and 12 mobility, so Standard care and high mobility. The assessor has contradicted herself on the managing treatments descriptor, and we stated she needed min 4 hrs a week, meaning 4 points not the 2 she got, so she should of got enhanced in our eyes. She would only need 1 more point…there are a few other bits we feel wrong as well.

The DWP lady was lovely. I asked if decision had been made as if not we would like to send in additional information, she put me on hold and said a decision letter had been sent (so the two week decision time was correct).

I asked if she could tell me the award and she said no but if my daughter was up to talking she could tell her.

As predicted she got standard care and high mobility, and the lady said for her to do a MR if she is not happy.

Also told her what backpay she is getting, what date it was going into the bank, plus what payment she will get each month on a Tuesday.

Most lovely lady ever.

Daughter is considering what to do about MR as concerns that she is aware there is small chance they can reduce the award.
Also what would happens if award was reduced, would she have to pay back the back payment?

It’s one point…. How frustrating

Hi Lorraine

I have only ever known two people have their awards reduced at MR stage and they were quite exceptional. The majority of people find there is no change after an MR and 35% are successful.

If you're putting in for an MR - concentrate on the areas where you believe she should have been awarded more points and why. Don't put any emphasis on any areas of the report that will not lead to increased points (you can always put those in a final paragraph).
