TOPIC: INCAPACITY BENEFIT

Re: INCAPACITY BENEFIT 8 years 7 months ago #55064

Her IB will be affected if she earns over £85 per week gross. After that they will reduce her benefit by £1 for every £2 that she recieves. If she has been on her pension since 2003 informing the DWP now may cost her a lot of money.

I dont think thats right, Phil. I do not think her pension will not affect the amount of IB she receives if she has been on the IB coninuously since before the relevant date. I believe its the date the IB started that matters, not the date the pension started.

If your occupational pension, awarded at the same time as I/B pre-2001, and currently not means-tested,is to be protected underIB/ESA/CB (providing there's no break in your claim) will this'protection' continue when your year on esa/cb is over and you move onto ESA/IR?

I was told no, because pension income has always been taken into account when calculating means tested benefits.
