ESA appeal and new claim? was created by agnes
Hello Everyone :)

I am new completely lost member and wanted to ask for advice. My husband suffers from Behcets Syndrome, we applied for IR ESA in Feb 2011 but he failed his medical December 2011 we simply tought that his medical history says for itself.
He was hospitalised again and his condition got worst so we want to apply again for ESA as appeal may take forever. I found part time job work 16 hours a week and don't know if it will affect our claim?
And what is a procedure to withdraw appeal and claim again?
Any advice appreciated :)
Many thanks

Wishing everyone a good day!

With respect to your question, you can only make a fresh claim for ESA, if either, your medical conditions have deteriorated, or you have new medical conditions since the date of your last failed claim, or 6 months or more have elasped since the date of the last adverse ESA decision.

An appeal can be withdrawn at any time, by putting your request in writing to the Tribunal dealing with your appeal, it may also be advisable to send a copy to the DWP.

Please take into account with the ESA WCA, that it is not the medical conditions that give an award it is the resulting limitations, it is a "Capability Assessment".
