" Sorry! Does this mean that after the 365 days, if I am deemed unfit but not unfit enough to get into the SG, then they will pay my NI, or if I get worse, then I might be able to get into the support group?"

Yes, that is correct.

Thanks both, I will have a read through the link. CAB tomorrow and hopefully between you and them I will have more of an idea of what is happening.

I was trying to reply to Mrs Hurtyback to say thanks but please could you please phrase it more simply for me? I didn't understand your first answer and it was then my fault for asking 2 questions in one sentence..but then I hit reply instead of submit and it vanished.

I'm assuming yes is the answer to both questions? I'll read more from the link.

Hi, I was put into the limited capability for work (WRAG) group in 2009 and received contributions based ESA. When the rules changed for contributions based ESA limiting it to 365 days this meant that as I had already received it in excess of 365 days I lost the benefit on 30th April this year.(despite the fact I have a progressive disease -Rheumatoid Arthritis) for which there is no cure. I no longer receive any benefit but the DWP do pay my NI contributions.

Today I received form ESA50 from Atos asking me to complete and return it within two weeks. I telephoned the DWP and they said that because they are paying my NI they will continue to need to reassess me, should my condition deteriote then ESA could be reinstated if I got into the support group.

Good luck

lizzie

Thanks, Lizzie

It seems a very confusing and unfair system. I hope it all works out well for you.

I got some good no-nonsense advice from the CAB today.

Along the lines of "concentrate on appeal and worry about the rest later" which makes sense I suppose, but it's hard not to be majorly worried about the whole thing.

Apparently benefits are changing, or there's going to be changes to the benefits, (or something else I can't remember) next April (?) but I don't know what.

This sort of goes along with what the helpful person at DWP told me yesterday when I asked about what happens after 365 days if I can't work or sign on or claim ESA, which was along the lines of "something is being looked at but we don't know what" or something. Forgive the vagueness, it's been a long week and I am like a zombie.
