Inaccurate Atos report

Inaccurate Atos report was created by panther50
I have had a decision from the DWP that I have been given CB ESA and put in WRAG. I have just got a copy of my ATOS medical report. I must have been given a cumulative 15 points or more, but from the report I can't see where. Whilst I am glad they have given me ESA, I am very unhappy about the report as it has facts wrong and says I should be fit for work in three months. I have a lifelong condition and suffer from depression, I was very distressed to read it and see how I was assessed in such a short time, how everything I did was watched and recorded in it and then how this unqualified person felt they could make a prognosis/diagnosis ignoring my GP and psychiatrist. I have read the ESA factsheet and I don't think I meet the descriptors for the support group, but I do get a total score of over 15 from the other lower descriptors for the LCWA. I don't think I have grounds to appeal to move to the support group, but this leaves the DWP with an apalling ATOS report and wrong prognosis - Is there any other way to correct the report or at least register my disagreement? The stress is starting to affect my health. They even recorded how long I sat in the chair for the assessment as evidence against me :( (I just wanted it over with!)- Be very careful!

Hi P50,

If you are unsure, on whether you meet the criteria for entry to the SG, and should therefore appeal your WRAG decision, you could seek professional face to face advice, see :

As a seperate issue, whether you decide to appeal or not, you could complain to ATOS, regarding the quality of the HCP's Medical Report, by writing to :

Thanks I have spoken to my MP, as I was so unhappy with the ATOS WCA at the time. I just feel even if I can't appeal I should maybe register somehow that I don't accept their findings, otherwise do you think it could have repercussions when I'm called in for the next WCA? Or will that be treated as a clean sheet?

Whilst your previous ESA50 may be available to those making a Decision on a future assessment, their task is to review your capabilities at that point in time, not as it was some number of months before.
