ESA IR was created by Metallichick
I won my appeal for ESA back in March of this year and put into the WRAG but as it was contribution based due to time limitations all payments stopped 30th April. Since then i have recently filled out a new ESA50 (had to ring DWP today to confirm they had received it as i had no confirmation) My husband has now been made redundant & i'm not sure if i am to apply for ESA IR now or if he should claim JSA and add me to that?

Any advice please

You need to get face to face advice from your local CAB or Welfare Rights office, where they can sit down with you and go over all aspects of your situation. See

Thank you Gordon, i'll ring CAB in the morning...

Can i ask another question please? Playing devils advocate, If i'm advised to go down the ESA IR & at my next assessment i lose & am taken out of wrag (going from my last experience i'm thinking the worse)obviously i would appeal. But during the appeal process is money still paid or does it stop until the appeal outcome has been reached?

As it stands at the moment, and you should read nothing into that :) if you are entitled to Income Related ESA, then you will receive the ESA assessment rate while you appeal.

Just FYI I also won my appeal at the Tribunal & Courts in January this year and was placed in the SG having been in the SG since April 2011 but then at the end of March I received a letter informing me that I should have been in the WRAG and since the 365 days policy was coming up at the end of March my payments would stop due to the fact that our income was above their limit, my wife is retired and receives State Pension of something like £607p.m and between us we have two small work pensions of £48p.m. (Total £655p.m) to live on we get no other benefits and I have a heart condition and severe depression so I had to give up work so what do they expect us to do.
