Hi there,

I am hoping you can answer a quick query for me.

A family member had to leave work 6-8 weeks ago, due to having prostrate cancer treatment. No benefit claims were put in during this time and he is now hoping to return to work in the next few weeks, although he is still suffering from the associated incontinence problems. My query is that someone told him that benefit claims can be backdated to the actual date of diagnosis/leaving work. Is this correct? Also does it matter that he is returning to work shortly?

Any info would be much appreciated. Thanks. :)

Did your relative receive SSP, or any other payment, from his employer whilst off sick?

No,he has received nothing. he is self employed (taxi driver).

ESA can be backdated up to three months, although the first three days of a claima are not usually payable, the period must be covered by a GPs Fit Note.

Thanks gordon,

Do you know if it worthwhile him trying to claim esa for the few months out of work, as the recent programme on atos etc, showed that prostate cancer that is treated with radiotherapy would not be eligible for it?. He has had surgery initially also.

Also does the fact that he wants to try and return to work shortly have any effect on making a backdated claim?
