His intention to return to work does not prevent his applying for ESA. The Government often makes much of the statistic that a large number of claimants close their claim before a WCA assessment is carried out, they would like the public to think that this is because the claims were false, where as the thruth is that these claimant simply got better. For example, someone with a broken leg may not be able to work for six weeks whilst in a cast, but would be able to return to work once the cast is removed.
