Confusion on what to apply for ? or stay as i am?

Hi all im new here so not sure if im doing this right so bare with me. Well i am on DLA High rate care for my panic attack/ depression. I also get the low rate mobility, but a change to my physical well being has changed. i had 6 fibroid tumors removed in june this year and still recovering but since the op! i now have what my doc is calling Myalgia and a strong possiblity of athritius in my bones, walking has became so painful now my feet litrially burn to the touch and lags are just painfull i feel like a pelican who stands on one leg after a few minutes, so going out has become non-exsistant. i waiting for bone exrays and physio, should i appeal a refusal to give me high rate mobility or just leave it. I know its not going away soon, and the futures uncertain and im on many types of meds,which do not help, can anyone advise if i should appeal the first decision regarding high rate on mental health grounds or start a new DLA on the new physicall illness i have now. thanks all.

You cannot 'appeal' the decision now if your condition has changed as the appeal would only deal with your condition as it was when the decision was made. If your condition has worstened and is unlikely to improve, you should notify DWP of that change and ask them to look at your claim again. Be warned that DWP could look again at your care component, even if you asked them not to do so, there is a risk of losing what you already have.
