Once you have the ESA50 form it is critical that you fill the form and take onboard all the advice in the guides make the effort to encourage your GP to incorporate the points made in the ESA50 form and if nesscessary pay for a specialist report any factual information which can back up what you write on the ESA50 form is a must - this evidence might avoid a medical, an appeal and could bring a swift favourable decision.

You cannot rely on the DWP to contact your GP, they are under no obligation to submit an ESA113, more importantly, you have already passed the point where a Decision on your claim can be made without the completion of an ESA50, so you should expect to receive one. The next checkpoint is when your ESA50 is returned, when ATOS will make a Decision on whether a Face to Gace assessment is required.

I've completed the form today and sent it back, recorded delivery naturally. I have spent more time on this form than any other I have sent in previously under IB. I feel drained and stressed, i just hope if I'm called for a medical it's soon as the stress is enormous.

I accept I cannot rerly on DWP to send ESA 113 notr insist but presumably I can ask and if they agree they can consider its contents

Presumably DWP can waive the need to ESA 50 at any stage if they decide they have the evidence ?

However, what I am doingh in any case is preparing a online copy ofg ESA 50 just in the case that I end up needing it. I would rather have (from this stage) maybe 5 or 6 weeks to complete it than a month from its arrival

Hi XF,

As Gordon has previously advised, you MUST fill in and return the ESA50, PDF version or otherwise, by the deadline that you will be given. Failure to do so will result in your file being returned to the DWP, and your benefits may cease, without prior warning.

In principle the DWP can waive the issuing of an ESA50, however, you are ignoring the underlying ESA process in considering this.

When a re-assessment is started, including the transfer of claimants from other benefits , there is an initial check by the DWP and the "in-house" ATOS doctor to see whether a Decision can be made on the claim, this will be based on the claimant meeting one of the Exemption Conditions, the DWP will usually contact the GP for confirmation.

If the claimant does not meet any of the Exemption Conditions, then their file is passed to ATOS, for an ESA50 to be issued and a face to face assessment to be held if necessary. The DWP have no further involvement in the process until the file is returned to them by ATOS.

ATOS may request further information from the claimants GP, although this is unlikely, but will not do so until they have sight of the ESA50.
