If they are only call responders and I am asking them questions about my records, why do they not put you through to someone who knows what they are talking about. Its just daft.

Should I call them again then, despite him saying there is nothing on my file and atos saying the same. Do you know if when atos call the dwp do they speak to managers or just to call responders?

Unfortunately I dont have any way to record the conversation.

I have noted the date, time and name of the person I spoke to, but he would only say it is david at the bristol office, I don't think I have any other choice but to send a blank form back as they will not process it if they have no file for me, will they?

Would I need a copy of the recording at this point in time, or is it best to wait to see what happens?

My initial letter informing me of the changeover from ib to esa was from a jobcentreplus, in preston. Is this who I would write to then?

Thanks.

Hi pjd,

They would have to be trained and compliant in Data Protection issues, and would have your details on screen.

It is upto you whether you wish to pursue it over the phone.

It is hard to say, if and when you may need a copy of the recording.

Yes, you could post the letter to the address on your ESA transfer letter.

thanks bro58,

Do you know if when atos call the dwp, do they speak to managers or call responders though?

Also do you think they would process an esa form if they have no referral or record for me?

Hi pjd,

I do not know who they would speak to, as far as I am aware call responders in call centres only deal with the general public.

Theoretically, "no" the process is supposed to be, DWP refer you to ATOS, ATOS send out ESA50, claimant returns ESA50 to ATOS, ATOS carry out ESA WCA, and make recommendations, ATOS send ESA50 and claimant file back to DWP DM, DM makes decision.

In these crazy times, who knows how they are administering the process.
