Forgive me but we can we start from scratch with regard your questions :)

You say you are on ESA(IR), at what stage is your claim;

- are you in the Assessment phase (the first 13 weeks, in principle of the claim)?
- are you in the WRAG?
- I am assuming that you are not in the Support Group!
- were you found Fit for Work on this claim?

As you have not replied I will make some assumptions that you are still in the Assessment phase and awaiting an assessment.

This being the case, the most immediate thing you need to do is to re-new your current Fit Note as payments will be stopped if you do not. A continued failure to provide a current Fit Note will result in your ESA claim being closed and you will not be able to make new one, and be paid, for six months or until you attend an assessment.

The next stage will be your assessment, without any details of your problems it is difficult to advise, but I would recommend that you have a look at our ESA Claim guides, you also might want to have a look at the following

ESA Medical – What to expect

Did you get a Statement of Reasons from the last Tribunal, that you failed? It would have given you some understanding of why you failed to score sufficient points.

Thanks for your reply.

And you are correct about my circumstances my claim is just over 3 weeks old in an assesment stage though i have already got the limited capability for work questionnaire. They have given me till the 26th of April to fill it in and gather all my eviedence, which is going to be very hard with the time i have got.

I seeked early advice because last time i was going through all this my specialist CAB worker got in touch with me twice through the whole thing and i was basicaly left on my own to fight the appeal, which i lost.

With the future being so unsure and with me failing my last 2 medicals, I have to know what will happen if i fail the next medical before i fill in the questionnaire and comitt to this.

I have heard that nearly 900,000 people have been so unsure that they have been forced to go on JSA.

The ESA rates during the Assessment phase are the same as the JSA ones, this will also be the case if you appeal a Fit for Work Decision, so you lose nothing by carrying on with your claim.

The Descriptors and Regulations will have been updated since you last completed the form, the changes may not affect how you complete the form, but you none the less should be aware of them. If you are a full member of B&W then you can access our ESA claim guides in the Members area.

So the rate of ESA will stay the same if i score 0 points on the medical and go ahead with an appeal?

Sorry if i seem confused as things have changed alot, and the rate of ESA before i failed a medical last year was £188.00. Then when i appealed it, the rate went down to £142.00.

I just wanted to make sure that rate will not go down if i fail the medical again.

I hope that makes sense.

From your previous post I would think you were in the WRAG after your successful appeal.

So if you are found Fit for Work, you can appeal and providing you continue to provide Fit Notes, you will be entitled to the ESA Assessment rate until a Tribunal hearing is heard.
