2. If I put in an appeal, it goes to a different decision maker first for reconsideration I presume they actually read it or is it just all done with what the computer software spits out like the first time?

Hi Basil,

1. It may do, they have to take into account your limitations, and any reasonable adjustments that may need to be made.

2. The DWP DM's do not use the LiMA software in coming to a decision, it is ATOS who use this in carrying out the assessment.

The reviewing DM should look at your case from a fresh viewpoint, and make a decision on the balance of probabilities, taking into account all evidence which will obviously include the recommendations made by the ATOS HCP.

The decision on whether to appeal or not is only one that you can decide.

We have seen many members who have successfully appealed WRAG to SG, and they have had the adverse decision changed in their favour at the automatic reconsideration stage.

Thanks Bro

The doctor I see is fully booked so just waiting for a phone call to explain to him and see if he will do an additional letter with regards to the effect on my health. The only descriptor I gave for support group was walking, the others were not although I put in the comments boxes relevant information about how my conditions affect me along with up to date medical documents, I could actually go back to 1972 as I have 4 box files full of documents. Never added anything from more than 2 years ago just onset dates to prove this has effected my health for over 30 years.

Suppose I am lucky last medical I had was 2008 and still got the letter saying I am unfit for work. :laugh:

Fawlty , hi , a person I represent was in exactly the same position as you and I appealed immediately .The original decision was changed .
I know it's stressful but it's the principle of the thing that if you believe yourself to have been put into the wrong group and you have grounds to object on it you have to try to gather the strength to appeal . Good luck .

There is no walking test! It is a test of your ability to mobilise, which in addition to walking, considers your ability to propel a manual wheelchair over 200m, the use must be reasonable but where this is the case, it will be assumed, irrelevant of whether you actually use a wheelchair or even own one.

That's the one I meant mobilising, I did actually mention in the forms I am not allowed to use aids and even if I could a wheelchair would be out the question as I have a disability with one arm so would spend hours going round in circles. :laugh:

I am leaning towards an appeal now I have had time to think as I believe I should be in the support group. Spoken to my doctor and he is going to do another letter making more of a reference to conditions which affect my mobility as it applies to one of the descriptors and he seemed aware of Lima.

I know Gordon said it won't make much different submitting it with the GL24 but least it will give the DM something extra to read and I will just add that I will submit further evidence if and when it becomes available.

Being a pain but do I phone the DWP and ask for the ESA85 now, presume that is what the computer spits out at the end. Seen it on the site as ESA85/85A but not sure if one is CB and the other is IR as I am in the IR ESA.
