my sincere apologies for the further difficulties you have experienced.
Hopefully something can be sorted out but if not it looks like as you say i will have to attend or face loosing benefit. It will all come down to weather or not my partner can get the day off which is doubtful with such short notice, if that's the case then all i can do is present my case to the decision maker and hopefully he will understand or the person at ATOS who is contacting me via email will be able to sort something.
Thanks for quoting the guidelines though it lets me know exactly where i stand at least.

Don't give up just yet,
You could argue that even though you apparently agreed to this appointment on the 19/06/13, that you did so under duress, as the ATOS person that you spoke to, gave you no choice.
Ask them to check the recording of the phone conversation.
The more pressure that you exert, the more chance of getting what you need.

Most of these phone conversations are recorded, so you could insist that it is investigated, and make a complaint against the ATOS "No Mark" that you spoke to. These people think that they can do as they like !!!!

This statement needs highlighting, as the previous appointment was cancelled by ATOS, and it was not a case of you not being able to attend.
This happens because ATOS double book their appointments, to ensure that they have a steady stream of assessments.
I would also highlight this as well, as it's common knowledge.
I would e-mail them back, ASAP, as you don't have a lot of time to get this resolved.
Of course, the decision is entirely yours.

Yes, just spotted that MHB,

I had edited "first" to "previous", still doesn't alter the fact that ATOS cancelled the last appointment, and not SM, and the fact that he has been coerced into taking an appointment that is not suitable, with less than 7 days notice.
