  			 				Hello all,
I was hoping that, later today, I would be posting to say that I had won my ESA appeal.
 
I was just about to set off for my tribunal, when I received a phone call from a clerk, saying that my appeal was being postponed.
 
I had requested a late postponement, a week ago, to enable more time to obtain a letter from my GP. I had contacted him, but he's been away on annual leave. This request was refused.
 
The clerk, today, said something about putting it back before the DWP, and possibly obtaining medical evidence. I admit to being worried about the last-minute ( less than 2 hours ) postponement. I had got myself psyched up for today.
 
Does anyone have any idea whether this turn of events is a good or bad thing? I shall probably know more when I receive a letter from the Tribunal Service.
 
I suppose that if the DWP contacts my GP, at least I won't have to pay for a letter
 . It's just the usual worry with long-term M.E., that there is little written evidence to see.

There are lots of reasons why a Tribunal hearing would be postponed, not least that one of the panel members is ill.
 
As far as I am aware, if the panel have requested further evidence, it will not be the DWP doing this, then it would result in an adjournment not a postponement, nor would the DWP looking at your claim again, result in the hearing being delayed either.
 
So, I would not see the postponement as good or bad.
 
I would also recommend that you continue to pursue your GP for the letter, as the Tribunal panel will not ask them for a report, only a copy of your medical records, if they require a medical report then this would be done by a court appointed assessor.

I shall pursue the letter. I already have a summary of my medical notes; it simply confirms diagnosis, but contains nothing as to how it affects me.
 
Knowing there was liitle in the notes is why I had not attempted to obtain a letter earlier.

I had the same thing happen to me last October, a phone call on the morning of the hearing to say they were adjourning the hearing as they needed more medical info from my GP.
A few days later I received written confirmation and that depending how quick my GP was they would try to arrange a new hearing within 28 days. However in my case it took my GP quite a while to return the info requested and my hearing took place in March this year.
I was only in the room for 5 mins and the judge said that they had found in my favour. I was not even asked any questions.
I know from my experience it is a worrying time but try to be positive.

  			 				This happened today to me as well!  I got a phone call at 12.30 to say it was postponed and my appeal was due to be at 4pm.  I think its a unprofessional to be calling us at the last minute.  I can understand what you are going through, as I was all ready to go today as well.  Good luck with getting a new date shortly and I hope the outcome is positive for you. xx
