Yes, it can be very confusing mg,

The problem is we still have some of the original ESA Regs 2008 in force, then we have the ESA Regs 2011, we then have the ESA Regs 2012 Amendments to the previous Regs, which came into force post 28/01/13.

Then we have the ESA Regs 2013 which will come into force after October 2013 when UC takes in IR ESA. :side:

In answer to your query, you are correct "Question 18 Part 3 Eating and Drinking" of The new ESA50 01/2013 is only covered by Activity 16 of The SG Schedule 3 Descriptors.

Eating and Drinking can be fulfilled under both Physical and Mental health conditions.

Sorry to bother you yet again! My diagnosis has now changed slightly (I've still got what I had (various (mental illnesses) plus another mental illness)). Do I need to inform them of change of circumstances? Can I just write it on the form as well as the other 'illnesses and disabilities', considering, I believe, they don't look at your last ESA50 or ESA85 so they don't really know what you claimed for last time and they treat every claim like a new claim? For all they know I could have claimed for a physical illness last time (but it wasn't).

Hi mg,

I would simply note down this added diagnosis.

A differing or added diagnosis does not necessarily cause a "Change in Circumstances".

Remember, it is the limitations caused by the medical conditions that are important, not the medical condition or diagnosis itself.

Some people do take the view that ATOS do not look fully at an in depth ESA50, this may be true.

However, if you don't provide in-depth information, they cannot possibly take it into account, even if they wanted to.

Further, it makes it far easier to gain a positive outcome from any appeal/reconsideration if you have provided in-depth information at your earliest opportunity.
