ESA Appeal was created by Mick Egan
Having recently gained 0 points and ESA stopped,straightaway my GP refuses to discuss my going to work and gives me a 4 month sick cert,is there any value in including a full reply when returning a GL24 appeal form at this stage or should i just return it with the sick cert?

Hi,
Welcome to Benefits and Work
If your forum name is also your real name, you may wish to change it to maintain some anonymity.
This can be done quite easily by following the instructions on this FAQ
My full name is showing, how can I stop it?
If this is your first "Sick Note" (fit note/MED 3) after being found "Fit for Work" it can only be for a maximum of 3 months duration.
If you send the MED 3 as is, (for 4 months) The DWP can refuse to accept it, and return it.
Legislation states that the first and second MED 3's can be for no longer than 3 months each. The third and any subsequent MED 3's can be for 6 months or longer.
Therefore, I would advise that you phone your G.P. and ask them to amend the MED 3 to 3 months only.
Once you have that, you should post it with The GL24, (keep copies of both) once the DWP have received these, you should be entitled to payment of Assessment Rate ESA whilst appealing.
You Med 3 should cover you from the date that your benefit ceased.
Sending Documents to the DWP or ATOS

Thanks,have rang surgery and have to return original for amendment, wouldn't have had an inkling re that,i was thinking of returning GL24 with a paragraph for paragraph reply to their medical report,would that be wise or pointless? Much obliged MickE

Hi,
You could point out any discrepancies in the Medical Report, however, this will not necessarily help you gain access to The WRAG or The SG.
The important issue is to show that you score the minimum 15 points required for WRAG entry, and/or you qualify for The SG by fulfilling at least one of The SG Descriptors.
