Scottish Angel wrote: Hi, I was wondering if folks could help/advise.
Ive since received my form with a july deadline, for handing in.
I was unsure what guides to follow as, i see that there has been two different forms along with two different rules and some may be applicable.
My Ib was for review in 2012, though have not received, a form until now it is the new form with the esa5001/13,
Im slightly confused with the changes, as my form has to be handed in few days before july changes, when i am assessed will i fall into the old rules category, or will i now be assessed under the new system.
What is the difference with the old rules to the new ones.? for appeals etc
Sorry if im longwinded but i was just hoping someone to help, before i make a start, with some headway with the forms.
Many Thanks,
Hi SA,
If it is the ESA50 01/2013, then you will be assessed for ESA, not IB.
Forget about IB, it is defunct, and all IB, IS and SDA claimants will be transferred over to ESA before Spring 2014. (this is what is happening with you)
You can use The Pdf ESA50 01/2013 if you wish, which can be downloaded from this page :
Using The PDF Version Of The ESA50 Questionnaire
Whilst referring to the Claim Guides under the heading :
"New ESA50 form"
On this page :
ESA Claims Guides
There is also a guide entitled :
"Being transferred from incapacity benefit to employment and support allowance. A 22 page guide to the transfer process"
At the top of the same page.
Do not miss your deadline to return your ESA50, or your file may be returned to The DWP, and your benefit may cease
How long do I have to complete the ESA50?

If this question is regarding the difference between ESA and IB, there is a massive difference, and you really should forget about how and why you might have qualified for IB.
If it is regarding the difference between the pre 28/01/13 (Old ESA50 03/11) qualifying descriptors and the ones after that, (New ESA50 01/2013) it is mostly in some wording, and how the descriptors should be applied with respect to recent case law.
This is explained in our "New" ESA Claims Guides.
