Hi mj,

Entitlement to IR ESA, if you are not entitled to CB ESA, is not a given.

To be entitled to IR ESA, the claimant would first have to pass the means test with respect to household income, capital, assets and savings.

e.g. The claimant may be in receipt of an Occupational Pension, they may have in excess of £16,000 in capital, assets and savings, or they may have a partner who works more than 24 hours/week.

All the above examples could preclude the claimant from being entitled to IR ESA.

The claimant would therefore have to be financially assessed to see whether they are entitled to IR ESA.

Asset rule for ESA(IR)

24 hour work rule for ESA(IR)
