Getting ESA50 form in on time was created by scamp
Hi there. My brother filled in the ESA50 form. It was due in on the 18th May and so he posted it on 13th May. Today he got a letter saying since the form had not been received he was being taken off ESA. When we phoned to find out what was going on we were told that their maillng system can take up to 9 days because things go to a central office and are then redistributed to the appropriate centre - 9 days!!!

Surely they should warn you that you have to post things 10 days before they are due

We've seen this BS several times recently, the claimants responsibility is to ensure that the ESA50 is returned to the required DWP address by the required date, any time it then takes the form to make it to the correct department is not the claimants problem.

Did your brother send it be recorded post? If they have proof of delivery they should contact the DWP again and make them aware of this, although they may need to provide a copy of the ESA50 and anything attached.

If they did not send it using a tracked post, then they should send a copy to the DWP office dealing with their claim as soon as possible, there is still a chance that their claim can be re-activated, although they may also have to request a Mandatory Reconsideration.

How do you request a mandatory reconsideration? We got Job Centre to scan in replacement form and email to the appropriate department. Currently in limbo waiting for a response

The request needs to be in writing and sent to the office dealing with the claim. there are template letters you can use in the ESA section in the Appeal submission document.

Hi

Not sure how to put new something new up,
I sent off the ESA50 review today and by special silver delivery it will arrive tomorrow to the Wolverhampton office. 4 days within deadline of next week.Then I realised latest reminder letter is from Wembley Centre for health and disability assessment not Wolverhamptonand to return there.....Have I done right?

As long as you used the supplied envelope it should not be a problem.
