ESA Assessment Rate & MR/Appeal was created by glimpy123
Having been found fit for work and then requesting a MR but not claiming JSA, once your MR is rejected and you go to appeal and request ESA assessment rate, is the ESA assessment rate back paid from the found fit for work decision or from when you lodged an appeal?

Providing this was your first Fit for Work Decision or the first since you had an award, then you can claim the ESA Assessment rate while you wait for an appeal hearing.
Once you have made a request for appeal and you and the DWP have received notice that your request has been accepted then you can contact the DWP to be paid the Assessment rate.
If you have not claimed any other benefit then your ESA can be backdated to the day after your original claim was stopped, providing you are able to provide a Fit Note covering you from that date, you will need to provide on-going Notes until a Decision is made on your appeal.
