I am still claiming DLA HM LC. Still waiting for the dreaded letter to claim PIP A close friend was assessed recently, she is a wheelchair user and suffers with severe COPD. Scoring 0 points for both components of PIP, she has a disabled shower, stairlift and handrails throughout the property all installed by Social Services, the Nurse who assessed her stated that my friend did not need to use these aids or adaptations. This has thankfully be overturned at Appeal she was awarded 10 points for DL and 16 points for Mobility. My question is how does the HCP have the power to state she doesn't need the aids when she would have gone through a vigarous assessment by Social Services. surely the DM could see the issues and overturn the decision without MR or Appeal
The HCP is stating an opinion, like all opinions it can be correct and it can be wrong.
It is possible that the claimant did a poor job of explaining their problems, perhaps they thought that having the aids would sufficient indication of their problems, it isn't, they need to still explain these in detail and in regard to the PIP Descriptors.
