I have won my esa appeal after attending a tribunal, my question is what happens next? I've heard the DWP are likely to try to appeal. How will I know when it is over and the full rate will be paid?
Also, I've been recommended no new assessment of 2 years, is that from the date of the tribunal or the date of last year's assessment?
It usually takes the DWP 5-8 weeks to process a Tribunal result, I would ring them next week to make sure that they have received the Decision Notice.
Whilst the DWP can appeal further, as can you, it's unlikely that they will. If they do then you will be contacted about it either by the DWP or the Tribunal Service.
The panel's recommendation on when you will be reassessed is unfortunately not binding on the DWP although they usually follow it, it's most likely that they will take the two years from the date of the Decision that you appealed.
