I was placed into the WRAG group for income related ESA. I asked for an MR and was successful.

Have had my letter confirming this and to say that any arrears owed will be paid. This is to be backdated to my original claim date of 8th October 2018, I believe.

I have just telephoned them to ask about the payments as I am not sure how much I would be owed or when I will start to get the support group rate (have been paid my ESA today and it was the WRAG rate. No Christmas bonus either!)

I have just been told it will take up to 8 weeks for it to be sorted by the processing team and that it won't be until the new year I will recieve the support group rates. She also said that any arrears have been offered to the overpayment team (apparently I had a couple of overpayments last year whilst I was on CB ESA and was still receiving working tax credit) and that they will take the whole amount.

My questions are, does the above sound correct? Also, when I do start to recieve the higher rate of ESA, will I recieve this or will they take the higher rate away and keep me on the lower rate until the overpayments are repaid?

I've never had any letter about any overpayments either, I may add.

I would be very surprised if it took eight weeks but Christmas will delay it being paid.

I am afraid that if you have outstanding overpayments then these will be set off against any money that the DWP owe you from this revised Decision.

They have to pay you the SG rate if you are in the SG but they can make a deduction to recover any overpayment still outstanding. If you are disputing the overpayment or the amount then you need to contact HMRC.
