Hi everyone,
I'm moving in with my partner of nearly 7 years. We're both on IR ESA in the support group. We both live in different council areas so I realise we will need to make a joint claim. However I'm in the middle of an assessment phase for my ESA. Forms went back begining of December before the moving process began. So I'm not sure if that would have any bearing or make it more complex. What I'm most worried about is, will this automatically mean we are transferred to Universal Credit? Will this affect my PIP which I claim separately? I guess I'm just panicking. My partner also had a bad experience as well with his CMHT, he was referred back to psychiatry by his GP and he ended up seeing a locum because the psychiatrist he had meant to see had cancelled on him twice previously. In the span of one appointment this locum decided that my partner had never suffered from a mental health complaint and wrote back to his GP that it was not appropriate for him to have access to services. So now I'm worried that all this might mean he might lose his benefits. To be clear he's been in services in and out since he was 9 and has experienced both auditory and visual hallucinations as well as delusions. Though they've never been able to diagnose him as he doesn't fit the criteria for schizophrenia etc. So to suggest that he never experienced this or what he experienced isn't valid is ludicrous. I apologise for my long winded post, I deal with an assortment of anxiety and panic conditions and this has me spiralling. I appreciate any advice, guidance or support that anyone can offer.

Nothing in your post suggests a requirement for you to claim Universal Credit, however, one of you is going to have to give up their ESA(IR) claim and be added to the other persons' one, as there can only be one claim for an Income Related benefit in a couple.
There's no reason it should impact on your PIP.

Hi Thanks for the reply Gordon,
What you said is what I had expected but apparently my partner spoke to advice works in his area and they said that because I'm moving from one council area to another and therefore need to claim housing benefit there that automatically triggers a Universal Credit switchover. Is there anywhere I can find out for sure? If I can I'd rather avoid claiming Universal Credit.

A claim for UC would only be required if a new claim for Housing Benefit was required, so unless neither of you currently have an HB claim and you need to make a new claim because you are moving to a new property then either your partner will be added to your HB claim or you will be added to theirs.

If it's not too much trouble can you give me some guidance as to what to say at either the council or Jobcentre about this so we can avoid the need for a UC claim if they also suggest that's what needs to happen?
Is there any guidelines or anything I could quote about this? I really appreciate you taking the time to respond and helping to clarify.

I've struggled to find anything that you could use, most of the sites that cover the subject list the triggers for claiming UC, they don't cover the circumstances that you don't except by exception. The other problem is that many of the sites are not what I would call official ones, they are not central or local government.
Have a look at the website for your intended Local Authority, my search showed that a lot of LAs listed the triggers so at least you would have something authoritative that you can point them to.If you are told that you have to claim UC then ask them for a reference to the legislation that specifically requires you and your circumstances to claim.
