I may be misinformed (and I'm definately confused) but if someone is unfortunate enough to have to appeal against an ESA decision, then apparently they can claim JSA. But if you are appealling against an ESA decision how can you claim JSA (when a condition of claimimg JSA is that you are fit and available for/and to look for work) If someone claimed JSA when waiting for an appeal, what would happen if the persons GP provided them with fit notes stating that they were unfit for work anyway. Just something that is perplexing me. Thanks.

Most claimants will no longer be able to claim JSA, only Universal Credit but if they are able to then once their claim has been accepted and is in payment then they can present a Fit Note and be excused from any Job Search requirement for up to 13 weeks.

Previously people could claim JSA until their appeal was accepted - but I think they had to get fit notes for that time - max 13 wks?
but now you cant, so you would have to claim UC, and if you do that then you are stuck on UC

if you avoid UC for those first few weeks - then once your appeal has been accepted (to go ahead) then you can contact the dwp and ask to be put on - I think it is the 'assessment' amount of ESA, and that should continue until your appeal is heard
but you CANNOT do that before the appeal is accepted

(I am sure Gordon will correct me if any of that is incorrect)
