Hi Can anyone please tell me what this statement means? It is a statement from the DWP in response to a Upper Tribuinal judge asking for their comments on his findings.
''On behalf of the Secretary of State I have no objection to the case being dealt with in a short decision with limited reasons if the Upper Tier Tribunal Judge accepts my submission in its entirety''

It's nothing to worry about, UTT hearings can be held in a variety of way, at one extreme it is done on the papers submitted by the claimant and the DWP, at the other is an oral hearing with an exchange of documents and arguments.

The DWP are saying that they are happy for just a paper hearing, you will be/have been asked the same.

Hi Gordon...I received a letter from my local 1st tribunal office informing me they will arrange for a new appeal hearing as soon as possible.

Does this mean it could still be on paper as the DWP stressed on another paragraph

5. 'The Secretary of State does not request an oral hearing'

OK, have you had a result on your UTT appeal? The letter saying a new FTT hearing will be arranged suggests that this is the case. This would also alter my reply to your original question.

The above statement came in additional comments from DWP in a letter to me from Leeds tribunal office. I had already had the letter from the UTT Judge 2 weeks prior informing me that he had made the decision to allow the appeal.

Just saying, I can find no help on the pages referring to UTT, apart from how to apply etc., I searched the forum last night and could not find a single post. There seems to be a lack of support/knowledge or help in this subject

So your UTT appeal was successful! In that case, the DWP letter is saying that they are happy with their original submission and it can be used for the new hearing.

We don't provide anything other than basic support for UTT appeals because it is not practical for us to do so they are entirely dependant on the papers involved in the appeal and the Judge's statement of reasons, no two appeals are the same to the extent that something that is considered an Error of Law for one appeal may not be for another one.
