Hi
I put in a PIP claim in November 2018 and I was called in December 2018 saying an assessment cancellation had come up for the next day. I took the cancellation and attended my assessment.
I requested a copy of the assessment a week later when I knew it had been received by the DWP. When I read it I was disgusted that it didn't reflect what was said at all and things had been put in that didn't happen. I wrote to the DWP and explained. A case manager called me and said although she couldn't take the letter into consideration for my award I should make an immediate complaint to the PIP assessment service and also gave me the details to do the complaint. She said should the award not be in my favour I was to request a mandatory reconsideration and ask for this extra information id already sent to be looked at.
I made a complaint and addressed all the errors and advised them to check CCTV to see that I wasn't wearing large heavy boots, also to see I wasn't carrying a bag and to see I also wasn't walking at normal pace. There was many other errors about additional paperwork I handed in on day not being mentioned in report.
Ive just had a reply about my complaint and they have spoken to who did my assessment and he said heavy boots meant footwear. They advised they also checked CCTV and saw that I didn't have large heavy boots on and that I in fact didn't have a bag. They said they have advised him of this error to make sure it doesn't happen again but as they dont get too many complaints about him they are happy he is doing his assessments correctly. They state that they agree with some of my points and some they can't answer. They said as i've already started a mandatory reconsideration I need to tell DWP why I disagree with the assessment report and not much more they can do as out of their hands.
The DWP had said I may be offered another assessment by the assessors due to my complaint. This hasn't been the case.
Is it worth me sending a copy of the response to the DWP and asking them to consider that they send me for another assessment? Surely as they have agreed there is errors it should be an invalid report.

Has the Assessment Provider actually said that the report is invalid or sub-standard? If they haven't withdrawn the report then a second assessment is not going to be requested.

Your post suggests that you have already requested an MR, have you only dealt with the issues in the report? Have you looked at whether you have adequately explained your problems completing the PIP activities? Is there any chance that you have failed to understand the criteria? Did you detail what you could do reliably and on the majority of days?

Thanks for your response.

No the assessment provider didn't say the report was invalid or sub-standard. They just apologised for the errors in report and said another part was corrected when it was audited too.

Yes I sent a MR when I received the award notice as I scored 0 points in both care and mobility and I didn't want to miss the deadline while waiting for a response to my complaint.

I didn't just deal with the issues with the report I explained in lengthly detailed accounts as to why I believed I had a problem completing the activities and attached medical evidence which would show why I would have problem with the activities. I think I have understood the criteria as i've filled out numerous forms since PIP started for a family member and 2 friends and they have been awarded PIP without many issues. I gave a full account also of what I could do and couldn't do on the majority of days by attaching a diary. The diary was sent with the original claim form.

You'll have to wait for the MR Decision, I won't sugar coat it, DMs usually treat the report as accurate unless the claimant can show fundamental flaws it, so there is a good chance that the Decision will not be revised.

If you don't have an award then you can make a new claim immediately, or you can go onto appeal. I don't advise doing both.
