Yes I was and remain in receipt of income related ESA so that does make a difference to the situation. It was a shock they would treat me as a potential benefit cheat when I had gone way beyond my obligation to bring the inheritance to their attention. However, I am fortunate to have great support from Mind who have helped me win 3 appeals for ESA so I am sure the letter from them meant the DWP dealt with it promptly and put my benefit back in payment. In my situation the worry that I knew they had overlooked the original letter and I was receiving the wrong amount meant I felt I had to contact them again- I was furious with their initial response though! No apology of course!
