Good Afternoon

I receive full rate mobility and daily care PIP and support group ESA. I recently advised DWP of a change of circumstances in that I am now in receipt of a private pension. I provided the details and they adjusted my ESA downwards. I am not in receipt of means-tested benefits.

I was therefore shocked to receive an interview summons saying "We are reviewing yours benefits and circumstances."

It goes on to say they need to talk to me about some changes that may affect my benefit payments.

Can you hazard a guess as to tbe reason behind this letter? I have tried endlessly calling the number given, but no answer.

Do they have the right to dig into my financial affairs when my benefits are contributory? Could the recent ESA change have been mishandled which has triggered this letter?

Grateful for any clues or thoughts about this. I recently established that my next ESA WCA is in 2021 and the PIP award is indefinite.

It is undoubtedly connected to your telling them about your pension, you need to comply or you risk your ESA being suspended and yes, I'm afraid they do have the authority to request your financial information.

Thank you. But I must make clear that I have fulfilled my legal obligation to advise DWP of my new pension, & therefore change of circumstances.
They sent me a request for further info. & an envelope. I returned same. They sent a new assessment of ESA which was less per week than before because of the pension rules which Iunderstand.
What more could I have done? If I had not done this, I could understand your teply. I mean they cannot summons all who duly report changes.....

Therefore I do not understand what gives DWP tbe right to summons me when I have done what was expected of me and have their letter of acknowledgement & re-assessment.

Have I missed anything, or perhaps time lags mean there is an erroneous cross over?

Tbe only other thing that has happened is that probate was granted relating to my late mother. It transpires that there was an overpayment of attendance allowance. But I am a representative in that matter and tbe liability is an estate one not my personal one.

Given what I have said, if you still maintain that DWP can summons me after I have acted correctly, please let me know. It s also something that everybody needs to be aware of, surely?

I am quite sure that you have done everything that you needed to.

As to the DWP, all I can say is that it is because they can.

It could be you now qualify for the severe benifit of IRESA , and depending when you notified them of backpayment may be due.

It would seem unlikely with a pension in payment as this would be deducted £ for £ from any ESA(IR).
