Hello,
I'm completely confused. I've been in receipt of ESA since September 2019 and have finally been awarded PIP backdated to March 2019. I've previously been advised by both ESA (over the telephone) and by the Law Society that I would get Disability Premium once I'm awarded PIP. After enquiring with the ESA they've now said i'm not able to get it because although i'm in the support group for ESA it's new style ESA and it's contribution based. I don't get housing benefit as I have a mortgage. Can I confirm this is correct? It appears as this is all a backdoor way of completely getting rid of one of the disability benefits. Am I right in this or have I got it totally confused? Thank you for any help and advice.

You need to get the terminology right, when you say that you are in the support group, do you actually mean the support group or LCWRA group, the first one is used in legacy benefits and the second one is used for NS ESA, check details on letters you have received from DWP in regards to your ESA. It will not make any difference to claiming premiums.

You need to be receiving what is called Income Related ESA to to eligible to claim SDP and not New Style ESA which is a Contributory only benefit, as the Premiums are only payable with a means-tested benefit. If you are on a non-means tested benefit such as 'New Style ESA' then you will not receive any disability premiums.

You say that you are in the support group, therefore your NS ESA will be on going until you are re-assessed, if you were not in the LCWRS group but in the LCW group then your NS ESA would only last one year.

I would recommend that you put your information into one of the online benefit calculators to check any entitlement to additional benefits.
