Mandatory Reconsideration (PIP), following decision on assessment (4 point issue was created by evilpoon66@gmail.com
Hello
I get UC (LCWRA), PIP and Carers Allowance. I care for my adult son, who gets UC (LCWRA) and PIP.
Just before the PIP 4-point changes were announced, I got a decision on a PIP assessment from about 3 years ago. The decision was no change to points (11 - Daily Living; 0 - Mobility), no change to award.
Initially, I decided that I wasn't going to challenge the decision, even though I am sure that I should be eligible for Enhanced Daily Living and possibly, Standard Mobility. I didn't want to risk losing the award, as I depend on the money to be able to live close to my son and to look after myself.
You can probably guess where this is going. I am just about to ask for a Mandatory Reconsideration and I'm collecting supporting evidence to go with it.
What I'm wondering, is that there might be a very long time before I get a decision. Perhaps, even after I get my PIP disallowed next year for not having 4 points in a section.
My questions are: is a delay that long likely and will my PIP be disallowed, whilst I'm waiting for a decision? Finally, if a case was at the waiting for appeal stage, could a Tribunal Judge have the power to "stay" a PIP disallowment decision, until the appeal could be heard.
This is the first time I've used the forum, so I hope I'm in the right section
Thanks and Regards
Richard

Hi Richard
Welcome to the forum.
If that is your real email address that you have used as your username, you should change it immediately. This can be viewed by anyone on the internet. The instructions are under 'my full name is showing how do I stop it' benefitsandwork.co.uk/guides-for-claimants/faq/forum#two
How long will it take for the DWP to respond to your MR? : - There is no time limit. It could be as little as six weeks and it could be months.
Will it happen before any changes in November 2026? I would hope so, but no guarantee.
Will your PIP be disallowed while waiting for a decision? The PIP changes have yet to be confirmed so it is impossible to give you a definitive answer
If your PIP had been stopped, but you had an appeal already in place, the appeal would continue. If you won the appeal, the award would be backdated to the point at which it was stopped.
