Hello, I live in a housing association property a mid terrace house. On Sunday my neighbour who I have had harassment from in the past parked their camp van in the hardstand outside of my kitchen window and left it there. On Tuesday I noticed that there was a soft toy with an open mouth placed on the dashboard facing my kitchen window. The opening of the soft toy’s mouth was big enough for a webcam or Amazon Ring cam to see out of. Last night after midnight when the street lights had been turned off I stood with my back to the sink which is under the window and using the front facing selfie camera on my iPhone looked out and detected a small red dot indicating that there may have been a cam hidden in the soft toy if the cam had infrared capability. I also took a photo. I decided that if my theory is right and the soft toy was concealing a cam and if the cam picked up my activity in checking for it with my iPhone camera that if this had been recorded in the cam’s activity history in its app on my neighbour’s smartphone that today they would move the camper van. That's exactly what they did move it this morning. I should point out that my neighbour normally parks their camper van in another part of the car park that’s for the flats next door and that this is the first time that the camper van has been parked for several days outside of my kitchen window. My question is if my neighbour makes false claims to the DWP claiming that I’m not disabled can the DWP use any illegally gained film of me that my neighbour took? My neighbour previously in 2023 made false allegations to the local council that I was keeping dog poo in a tin in my garden and my neighbour trespassed over the fence and took photos of my garden. I didn’t have dog poo in a tin. The person at the council said that it was clear that it was a malicious and false accusation. It is a waste of time for me in complaining to my housing association as the neighbours have someone in the housing association who acts as a mole and informs them when I make a complaint about their harassment. I won’t go into details here but this has been shown to be the case. Regards Haighleagh

I'm sorry that you are going through this. I'm afraid your question is outside the remit of this forum, but I will tell you what I think, although I am not trying to influence what you might do.
The DWP receive a lot of tips about people potentially gaming the benefits system, and in some cases, they will follow up on the tips and see if there is any truth in them. They don't follow up on all tips and there are a lot of malicious complaints. No, the DWP would not use film that had potentially been illegally obtained. You may want to consider logging the incident with the police.

I was a CAB advisor some years ago, and the law has changed since then. My gut feeling is that it wouldn't be used, as it would have been illegally made.
Thank you also for your sympathy and support. Like many people with disabilities and long-term health conditions, I do get harassment.
