Hi Gjoy
Was the lump sum you received of backdated SDP over £5000 and did you receive a letter stating for how long it will be disregarded?

Yes , it was considerably over 5,000 nearly 15,000
The letter of ESA said they would not add the money I received as any Capital or Savings I told them about. They called it "Capital Disregard" while my claim for ESA continues.
But said, if I make a new claim To UC after the 17th October 2025 my UC payment may be affected.
I received the money in my bank on the 17th October
I made my migrated claim to UC on the 13th of October.
I had a phone call on the 20th October and was asked to go to the local Jobcentre on the 24th October.
I took all relevant documents and letters from ESA stating about The payment and SDP.
I did phone rent services and council tax offices up to let them know, but was told the DWP gets in touch with them.
The Lady at Job centre looked at my banking app and how much was now in my bank accounts..
The lady did,nt want to look at the letters of ESA.
The Lady asked how I wanted my rent paid and I said direct to the landlord.
Then after everything I thought was sorted .I went home.
Today I received a letter stating that my rent has been suspended as the DWP have told them my income has changed.
I will be phoning all the relevant benefit services up, but I would like to know if I have to pay my rent and council tax myself now?
Thank you for your time.

Hi Gjoy
I would advise you to send a Journal message with recipient A Payment including the following narrative :-
EXPLANATORY MEMORANDUM TO THE SOCIAL SECURITY (TREATMENT OF ARREARS OF BENEFIT) REGULATIONS 2018 No. 932
6.4 In respect of UC, this instrument provides that any benefit arrears or payment made to compensate for arrears due to the non-payment of benefit, of £5,000 or more which are received whilst a claimant is getting UC, or were received during an earlier award of a legacy income-related benefit and the claimant migrated to UC within one month of their earlier award ending, and would have been disregarded, or were disregarded, in respect of the earlier award (as a result of official error or an error on a point of law), will benefit from the extended disregard until their current UC award ends.
You will have to discuss the situation regarding rent arrears with your landlord.
Let me know how you get on.
David

Thank you David for the information.
I did my phoning round.
UC told me my statement would be ready on the 20th November of how much I am entitled to and I could show this to Rent/ Council Tax departments as proof.
The rent service told me that I Just needed to make sure the 4 weeks until I get paid that my rent account does,nt get too much in arrears; and to make weekly payments until my statement comes through and then to phone them back( Rent services); send proof as I would be 4 weeks in arrears if I did not pay myself; as my benefit from ESA stopped the 27th Of October.until I got payment and proof of UC and to, 2 days before I got statement phone up UC and to make sure my direct payment to the Rent Office was in place and set up to pay the Rent Office direct.
I would not get refunded for these payments.
So just waiting on now how much UC are saying I'm entitled to now.
Once again David Thank you for your advice.
Will keep you up-dated.
