Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi nonsmoker2008
I think you described your situation and the personal anguish very well and I hope you get a reply from the DWP this week. Even though T Sharland is out of the office her inbox will be monitored by a PA and your complaint will be forwarded to the relevant manager.
DWP telephony agents often come across as curt and ill informed. Their performance at work is measured by the number of calls answered and not by the accuracy of the advice that they give. They are not given in depth Benefits training and usually refer to online guides such as DWP Universal Learning.
Hope this helps

Hi,
Most folk are only finding out at the point of migrating from ESA to UC that for some confusing reason part of their ESA claim was contributions based and this will convert to new style ESA after migration to UC
It seems lots of folk on the old income related incapacity benefit where automatically transferred over to CB ESA back on the day Which in my case was 2011
The dwp kept this a secret and always put on the annual letters that I was receiving income related ESA and never mentioned CB ESA
maybe nonesmoker2008 is in same boat as many others
Rik

Hi David
Its funny how putting on my journal I have taken it higher and included my MP got me a very prompt and thoughtful phone call from my UC case manger just now!
He too is mystified as to what ESA are doing, and agreed their paperwork to me sounds like they are definitely doing 'something'. He confirmed he had no access to ESA systems so had no clue about the letters I'd received.
He let me get it all off my chest (about this ESA issue anyway) and then let me ask all the other questions too. He was able to confirm they'd accepted my housing situation (untidy tenancy/absent joint tenant, in shared ownership) the same as HB had. He further confirmed transitional protection would be included (until it eroded)
So thanks to yourself and B&W, I can actually say my blood has stopped boiling for the first time since the beginning of October when this nightmare forced migration began

Thanks, and I could of understood it in that case, but I've never been on Incapacity Benefit of any kind. Income Support from 1991 to 2018 then ESA Income Related from 2018 to October 1st
