Hi to all the Moderaters on this website you are a life,life to us all.
I wondred if you could advise me please. I have my own house and I am on pip and esa contributions based until 2028.
I have major structural damadge to my house due to subsidence. I live alone and iam very worried the safety of my house it its very scary. My insurance are going drill and dig up all the floors and install piling in my house. so it will be uninhabital for a few months.
Am I right in thinking I will need to tell the DWP That I will be moving out on a temporary basis. I will still be in the area where I live and local ? However I dont want to do anything wrong as I know the dwp are very strict.

You should not have an issue with the DWP as the rules quoted below are clear though I expect some trouble with Council Tax as Council Tax departments at present are using any excuse to put up bills.

2168 – F2170
Other accommodation for essential repairs
F2171 A claimant who
1. has to move into other accommodation so that essential repairs can be carried out to their home
2. intends to return to their home following the repairs and
3. is liable to pay for only one home
shall be treated as normally living in the home which meets all of the conditions 1. to 3. above1
.
1 UC Regs, Sch 3, para 3(1)
F2172 Where a claimant has moved into other accommodation in the circumstances set out in F2171 but
is liable to pay for both homes the DM must decide which the claimant normally occupies as his home1
.
1 UC Regs, Sch 3, para 3(2)
F2173 In F2171 and F2172 essential means necessary and not a luxury.

Hi David
thank you for your reply. I worry so much the dwp are so strict.
My my home insurance policy covers me for alterntive accomodation when the house is getting underpinned.
They cover the costs of accomodation however. I will ask about the council tax payments with my insurer also.
I have been to my local council office and asked about council tax costs when i move out.
They said when I move out of my house they are saying even though iam a single occupant and get the discount just now.
if they move me they said I will have to pay for the full council tax on my house at full price even though iam not living in it.
The council said I would need to contact the Valuation office and fill a form out to get my house taken out of of the listings while it is made structurally safe.
the insurance should pay the council tax when i move to alterntive accomodation while the structural repairs are commencing in my house.
I have letter from the insurance and loss adjuster saying my house will be uninhabitable for a number of months. I can give the coucil copies for proof.

Unfortunately as I expected the Council Tax department is being difficult. You will have to check their bills for being over charged. If that becomes a problem you should be able to get assistance from your local Citizens Advice office.

I dont understand how the coucil can charge you concel tax in a house that you are not able to live in?

You will have to look at what your Council now has as a Class C exemption from Council Tax because the building is empty and being repaired.
Council Tax departments are unhelpful and won't tell you your rights, unfortunately.
