Please can you advise me. I was awarded PIP in 2018 living and mobility at the enhanced level . I have psoriatic arthritis and CPTSD. My pain and mobility has worsened with age 72. I had a reviewed in April . I was shocked at the lies and only scoring 2 points for my handrail in the bathroom. I lost my award. My mental health went down hill massively to a dark place. I appealed it and was awarded enhanced for daily living. As we all know things become much harder as we age. I sent letters from my rheumatologist that stated my decline in my hands ,knees and foot. My gp also supported my heath had deteriorated. My phychatrist also sent an update on my mental health. I have started my tribunal and am now falling to bits with this. I really cant face to go and sit infront of the panel it is just not possible for me . The thing is that I have now received a letter saying that it was adjourned and should of been held on the 9th of Febuary. I did NOT get a letter informing me that this was taking place. It says it was held in Pool on the 9th and has been adjourned for a face to face hearing so the appellant may give evidence on her health conditions and impact on her activities . This will take place in my town on the first available space. I have told them I want to do a phone review as I can cope better with this as my anxiety is awful most of the time. It continues to say within 14 days the DWP is directed to make a full submission on the mobility issue and confirm whether or not the appellant is permitted to appeal the mobility component as she has reached pension age on the 6th 7th 2020. Then say Members of this tribunal are excluded from future involvement.
My understanding is that if you started receiving PIP before pension age is that it will continue, is this correct when you ask for an appeal.
At the time when I had my interview on the phone the lady said I did not need to bother with consultant letters as I had very high points so I did not get any evidence together and lost my award. This horrid lady lied and lied. I told her that I had had more aids put in and new low steps ect. She said in her report that the aids were already in the property when I moved in.
I am wondering if I should give up as I cant cope with being accused of being able to do tasks that are so hard for me .
I am so afraid how I will manage to get help if they then decide to take my enhanced daily living. Should I just tell them I will not go through with this. Its such a cruel system. I need some help please to understand whats going on and some guidance on the way forward.
Should I call them..
thank you for listening.
My son is helping with the message using my own words.
Thank you.
I hope the post will be answered.

Hi buffy54

I'm sorry to hear of the position you find yourself in.

1. If you can cope with a Tribunal, you should go for it. If there was any danger of you losing your enhanced Daily Living, the Tribunal panel would tell you, and they would give you the chance to withdraw your appeal and your enhanced daily living award would continue.

2. You are correct that if a mobility award is already in place before a person's state pension age - then it continues after their state pension age for as long as they are eligible. In this case - there is no top age limit.

3. I'm sorry that you didn't have any evidence that you think may have helped your case. An appeal is your opportunity to put the record straight if you are able to do so. Don't call the assessor a 'liar' - however tempting it may be. You say that the assessor "Misunderstood" or "was mistaken" or something similar.

4. Only you can decide whether, with the support of your son, you can go ahead with the appeal. Do what is best for you. It's just that if you don't fight the mobility issue now, you won't be able to at a later date.
