Hello.

I am after advice please if possible.

I have been unwell for ten years, gradually getting worse.

At Christmas I had to stop work and have been on SSP since.

I submitted PIP in February and UCLCWRA end of March.

However, I am worried that I may need to withdraw my PIP as I'm not sure I answered one section properly.

If I withdraw my PIP, will I lose my UCLCWRA?

Obviously, it's your decision if you want to withdraw your application for PIP, but I would think about it carefully, and whether you have really not answered a section 'properly' and what impact that might have.

Withdrawing your PIP won't affect your universal credit application.

Dear JenBiddy40, if you are worried about whether you filled in the form properly, you don't necessarily have to withdraw your application. You can continue and see what happens, doing your best to put things right at the assessment and any subsequent MR and Appeal. You will get lots of highly knowledgeable support from the trained volunteer Mods on here, and people like me who've been through it already, with each step of the way if you just post your queries, as you've done here.
And we will all be willing you on :)

Thank you for your reply, I appreciate it.

There are two issues.

First one. I believe I stated my mobility correctly but am worried that due to a trip (one day) that it may not be seen that way as I walked all day because I had to push through, but it's why I'm now unwell and on sick leave. My condition is now worse, so I know it's viewed at assessment as how I am or my condition now, but I also want to be honest. I feel I have been but just don't feel the optics are good which concerns me.

I'm also worried, because I have said that driving makes me very tired and I have to rest after and have someone with me on unfamiliar journeys, that they may report this to DVLA. I'm hoping to eventually get back to my job but won't be able to if I can't drive.

It probably sounds silly, but I couldn't handle either of these things causing issues.

What Denby has said is very sound advice. I have had several clients who have not properly answered questions in the form, and then at MR or appeal have now said the (correct!) opposite and succeeded, so don't worry about that if you wish to continue. The test for all descriptors is what happens for the majority of days. This means it won't matter if you have better day/s and complete more activities than usual.
There are 4 criteria - all need to be fulfilled. If you can't reach the criteria on any given day, this will count towards the majority of days. Safety - is there a risk of substantial harm to you or another connected with the activity. Eg risk of falls, dropping hot food, bringing in an epileptic fit, putting yourself in danger generally both mentally and physically?
Acceptable standard- do you complete the activity in a normal way, do you create mess, slip hazards, put too much salt on food, burn food or yourself, leave the bath water running, etcetc . If you have significant pain or eg breathlessness this can also comprise not being acceptable.
Reasonable time - this means no longer than twice that if non disabled person.
Repetition - can you repeat the activity throughout the whole day as many times as required? - this is a personal level - so eg a person with incontinence will need to perform toileting more times than usually needed - can these all be performed safely, in time, acceptably? Dressing including shoes might be needed to be done 4 or 5 times per day. Cooking a meal might be 3 or 4. However communication might be required 24/7. Fatigue might mean that the start of the day is ok but evening you are too tired or ill to complete Pip tasks.
Aside from insignificant periods of time, if you can't repeat the tasks, as with not being safe, in time etc then this will indicate some level of points - maybe an aid etc or physical help. It you still can't meet the criteria with help then the likely score is the 'I can't at all...' score.
So, if you can manage to complete a descriptor activity unaided and acceptably etc for 13 days per month, but for the other 17, you have a variety of health issues eg pain, fatigue, so you can't repeat across each day, or you're not safe etc then these 17 days are all days when the criteria are not fully met and this will be the majority of days and hence some score under PIP should be awarded, as appropriate.
So, given your explanation - a single trip out won't preclude points. Moreover, it goes to prove that too much effort one day means you can't perform PIP activities (any/all) the next day/s.
As for driving, I can't say whether DWP might report you, but there is no requirement for drivers to be able to drive everyday. There are many people who have disability and can only drive when feeling better, this shouldn't be a problem.
Have a think, you don't need to give up.
