I had my original PIP assessment some time in April.
When I received the report, I was amazed at how inaccurate it was, so when I submittedy MR, I also made a complaint to Capita.
I got an appointment for another assessment, which took place on ** resulting in another zero award opinion, which of course the decision maker went along with.
I received a response from Capita to say that as there was no recording of the original assessment, that they wouldn't be doing anything about it, so I asked to have the complaint escalated, and provided the copy of the recording I had made.
After recieving the decision on the MRI, capita have admitted that the original assesment was not up to standard.
So now I have to go to tribunal, but my original assessment was deemed insufficient.
What are the legalities here? If the original decision was based on a report thatw as incorrect, how is it fair that my mandatory reconsideration was based on this report at all?
What would be the next steps?

Hi Katiee
You should have the name and contact details of the DM who responded to your request for a MR. You need to repeat what you have told me "After recieving the decision on the MRI, capita have admitted that the original assesment was not up to standard" and ask for the DM to make a revision.
