  			 				Hallo again, many thanks for your responses. I became a member earlythis afternoon and have read most of your requested documents.  I have completed and sent the form and am releived to say I did have my thinking cap on at the time, most of my reponses seem to tie in with your recommendations.  The whole system seems to be very complex and very unfair.  Its seems ludicrous that a computer print-out is relied upon to determine the validity of a claim.  It also appears that the role a consultant, GP, OT etc. is put into question. The role of the "Doc"/Nurse on the day also leaves a lot to be desired, imagine interpreting responses by ticking a box that could or could not be a near enough response!!!!  Whoever thinks these systems and frameworks up must be someone who has tried and tested the system themselves  ---  a con man

That is why it is so important that you understand how the system works.
 
The important thing to remember is that lots of people successully apply for ESA by scoring the 15 points necessary, it's just that you don't hear so much about it on the forums, but they are there. Just type "success" into the search box at the top of the page and you'll see just how many people win their claims.

  			 				Hallo again, had a quick look need to read some more though, just one more question. I am in receipt of the middle rate DLA which includes the carer portion at the lower rate.  I had no problem with this can u explain why?  do u think the consultant had a role to play?  would this help with the ATOS assessment ?  it all seems very inconsistent.  thks.

  			 				Just get ready to fail and be told you can work. Then appeal to a judge with common sence and you should be ok.
Its a long road but if you are ill then you will get it.

The criteria for DLA and ESA are completely different
 
DLA is all about understanding the extra needs you might have as a result of your disability, for example equipment to allow you to do things, or allowing you to have extra care at certain times of the day.
 
Receiving DLA does not mean you are incapable of working, in fact many of the forum members who are in receipt of DLA do work.
 
ESA is about whether you are able to successfully perform the tests that the government believe show that you are able to work. For example, the distance you can walk, how long you can stand, can you see and hear.
 
Have another look at the WCA tests in the doucumentation and you will see what the criteria are for the tests, you should look at how you would reply based on your own conditions. You will be asked about these at the medical.

  			 				I was assessed by an incompetent "qualified" hcp
 
My complaint regarding her incomplete lack of mental health knowledge has gone through
- tier 1 Atos complaints medical panel
- tier 2 Atos complaints medical panel
- tier 3 independent complaints medical panel
 
now with independent case examiner
then ombudsman
 
The next ESA 85 medical assessment was kindly arranged in September 2010 by the DWP decision maker for 10 February 2011. I won my appeal for ESA in July 2010.
 
I still have not received my new ESA 50 medical questionnaire because DWP state no one reads it
 
I expect another DWP decision maker rejection!!
