24 hour rule was created by pickles
Please can anyone inform whether a person who claims ESA & has a partner who works over 24 hours a week, will they lose their ESA entitlement & what can they claim to make up for the loss of income?
Was this rule the same when people were claiming incapacity benefit, or is this a new measure to 'help' disabled people back into work.

its just going through the house of lords now... if it goes ahead [looks as if it probably will
] the soonest would be April 2012, but backdated so anyone on CB ESA for 12 months will have their money stopped

Incapacity Benefit is a Contribution Based benefit and is not means tested as a result.Thanks for the reply

The 24 hour rule is specific to means tested benefits such as Income Related ESA.

I do not see how this will help people back into work if they will not receive any income for their partner.
They will also not be able to claim working tax credits for part time work unless both partners are working 24 hours between them. Stunning really.....
